Rathore's bail plea rejected, arrest possible any time

PANCHKULA (HARYANA): A Panchkula court on Friday dismissed the anticipatory bail plea of former state police chief S P S Rathore, who molested teenager Ruchika Girhotra 19 years ago, leaving it open for the Haryana police to arrest him any time.

Additional District and Sessions Judge Sanjeev Jindal dismissed the bail plea filed by Rathore after two fresh First Information Reports (FIRs) were registered against him Dec 29.

Rathore was booked under non-bailable charges like attempt to murder, criminal intimidation, forging evidence, wrongful confinement, fabricating false evidence and criminal conspiracy.

Neither Rathore nor his wife Abha Rathore, who is his counsel, were present in the court when the bail plea was dismissed.

Rathore had got interim relief Jan 1 from the court till Friday on his bail plea in the matter pertaining to the two fresh FIRs registered against him.

The court also rejected the anticipatory bail plea of another Haryana police official, Sewa Singh, a sub-inspector posted at Pinjore near Panchkula, who also has been accused of implicating Ruchika's brother Ashu in false cases of car theft, allegedly at Rathore's behest.

Sources in the Haryana police said after the court order that the state director general of police (DGP) and senior home department officials could now consult chief minister Bhupinder Singh Hooda before arresting Rathore.

The Haryana police, through the state government, have already recommended to the Central government that the fresh cases, including a third FIR charging Rathore of abetment to suicide of Ruchika, be handed over to the Central Bureau of Investigation (CBI) for investigation.

"I am happy and I have hope that justice will be done. We want him arrested immediately," Ruchika's friend Aradhana, whose family fought the case against Rathore for over 19 years, said after the bail plea was rejected.

Aradhana alleged that state officials had already been supporting Rathore in the past and that she did not have much faith in the state machinery to take action against him.

"The CBI is a more independent agency and I hope they will be able to investigate the matter properly," Aradhana added.

Rathore's counsel said after the dismissal of the bail plea that they would move the high court to seek relief.

Ruchika, a teenaged budding tennis player, was molested by Rathore, then an inspector general of police, in Panchkula August 12, 1990. Three years later, Ruchika committed suicide.

Nineteen years after the molestation incident, Rathore was convicted by a Central Bureau of Investigation (CBI) special court here Dec 21 and sentenced to six months' rigorous imprisonment and a fine of Rs 1,000.

The light conviction led to uproar in different sections of society, forcing authorities to re-visit the case and seek justice for the molestation victim.

A magisterial inquiry by the Chandigarh administration had Thursday indicted Ruchika's school, Sacred Heart school, and its principal for her expulsion on the flimsy grounds of non-payment of fee in 1990, just after her molestation incident. Open revolt in Indian hockey, players refuse to turn up for practice

NEW DELHI: Indian hockey plunged into a fresh crisis on Friday with revolting hockey players deciding to boycott the ongoing World Cup preparatory camp here for an indefinite period in protest against non-payment of their dues.

The players took the unprecedented step to stay away from the camp after Hockey India, the interim body which is governing the game in the country, failed to respond to two of their letters asking the authorities to make the payments.

"We have decided to boycott the camp indefinitely till we are paid our money. We took such a decision in a meeting of players last night", captain Rajpal Singh said.

"Earlier we used to be paid after every tournament but it is not the case now. We had reminded the HI officials a few times, but nothing has been done. We will now report to the camp only after we are paid", Rajpal said.

The players' revolt comes barely a month before the hockey World Cup in New Delhi and is bound to have a bearing on the preparations for the high-profile event scheduled from February 28 to March 13.

The senior players were annoyed by the delay in payment and had written a letter to Hockey India President A K Mattoo demanding that money be paid within seven days.

The letter had no mention about the pullout but sources said that the players had actually made up their mind to withdraw from the camp if the payment was not made in a week's time.

Hockey India (HI) is, however, confident of sorting out the issue and has called some of the senior players for a meeting in New Delhi on Saturday.

Six of the senior players --captain Rajpal Singh, Sardara Singh, Prabhjot Singh, Sandeep Singh, Tushar Khandekar and Arjun Halappa --will be in Delhi on Saturday for a promotional shoot and are expected to meet the HI officals to sort out the payment issue.

"I had received their letter two days back. I have mailed my response to them yesterday. I have called them for a meeting when the players come to Delhi tomorrow", HI President A K Mattoo said.

"I will talk to them and look into the matter to understand what exactly their grievances are. I am confident that we will sort out the problem soon," he said.

Although the players claimed that they had given HI time till January 8 to resolve the issue, Mattoo said no such deadline was given to them.

"There was no mention of the deadline in the letter. Above all, they are the national hockey players. They should not have threatened us. They can't keep the dagger on my head to make me work. But we are confident about working out a solution when we talk to them", Mattoo said.

The players said that on the previous occasions they were paid money in advance but this time the fee has not been paid even after the conclusion of the tournament.

"We would like to be paid our money for Champions Challenge in Argentina. In the previous three years we were paid Rs. 25,000 each for every tournaments before we left India. We would like to be paid this time too and as for the future tournaments, please make arrangements to pay well in advance," the players had said in the letter.

India had won bronze medal in the tournament, held in Salta, Argentina last month.

Rajpal said the players were forced to take such a step because Hockey India "did not care for them".

"Hockey India does not care for the players, it is very sad. The sponsors are paying the money, but the players don't get anything," he said.

Apart from their dues, the players are also demanding an increase in their pay packages and some incentives.

China edges past Germany to become world's biggest exporter

BEIJING: China has edged past Germany to become the world’s biggest exporter. Though Chinese exports have also suffered a downturn during the financial crisis, it has done better than Germany owing to Beijing’s ability to prevent any gains in the local currency and the economic stimulus package.

Germany indirectly conceded defeat in the race when its national statistics office reported export figures below the levels achieved by China in the January-November period this year. Berlin reported exports of $1.05 trillion while Chinese exports were $1.07 trillion (734.6 billion euros) in the 11-month period.

Chinese exports fell 20 percent in the first 10 months of 2009 due to the global financial crisis. But there are signs of strong recovery and arrest the slide in exports in the first quarter of 2010 besides making some possible gains.

Analyst said Beijing’s refusal to buckle under western pressure to revise the rate of exchange for the Yuan helped Chinese exporters to stay afloat during the bad time. Premier Wen Jiabao said in an interview with the State media in late December that China will “absolutely not yield” to calls for currency gains from trading partners.

It is Beijing’s political will to resist western pressure as well as develop new markets by enhancing diplomatic exchanges with Asia and African countries that has helped China to both diversify and retain its export strengths.

Another reason is the generous export subsidy offered to exporters, who often earn a lot more from government support than they do by selling goods in foreign markets. Low cost loans and grants also helped a vast number of exporting companies to survive, analysts say.

The Global Trade Information Services Inc. earlier said that China shipped products worth $957.7 billion as compared to Germany’s exports of $917.7 billion in the first 10 months of 2009. But it is only now that Germany has confirmed China’s clear victory over it in the field of exports.

Attacks on Indians in Australia tragic: Rao

New Delhi: Describing the recent attacks on Indian students in Australia as "tragic", Foreign Secretary Nirupama Rao has said the environment of fear and suspicion prevailing in that nation is not good for bilateral relations.

The violent incidents are of grave concern to us and also for parents who are mostly from the middle-class and send their children there at great cost and difficulty, she said.

"These incidents have shaken the confidence of Indian students and their parents about Australia," Rao said in an interview to 'Outlook' magazine.

"It is very very important to restore that confidence. A climate of fear and suspicion is not good for the relationship between the two countries," she said.

Commenting on Sino-Indian relations, the foreign secretary said, the cooperation between India and China at Copenhagen has helped establish a very positive paradigm.

Arguing that Copenhagen ought not to have surprised people, Rao said, "Setting aside what one many have seen in the media, we have to acknowledge that the relationship has grown tremendously in the last few years."

On Bangladesh Prime Minister Sheikh Hasina Wajed's visit to India next week, she said it will be a "landmark" event Indo-Bangladesh bilateral relations.

"Considering the spirit of mutual trust and confidence, I think both governments are on the same page," she said.

J-K remains vulnerable to cross border militancy: Chidambaram

New Delhi:The Government on Friday said the country, especially Jammu and Kashmir, remains vulnerable to militant attacks sponsored by forces from across the border.

Complimenting the state police and CRPF for successfully eliminating two militants in Lal Chowk area of Srinagar on Wednesday, Home Minister P Chidambaram said the militants were in communication with their handlers outside the country.

"The incident highlights the fact that the country, especially Jammu and Kashmir, remains vulnerable to militant attacks sponsored by forces from across the border," he said in a statement.

The Home Minister said at the same time the country's capacity to neutralise a militant attack has also increased considerably.

"I would emphasise once again that the country, especially the security forces, must remain in high level of vigilance but there is no cause for panic. We must remain calm and confident that our security forces can face any challenge," he said.

Top cop arrested in Mumbai, charged with murder

Mumbai: Encounter specialist Pradeep Sharma has been arrested along with two constables in connection with an alleged fake encounter case in 2006.

Sharma, who was involved in over 100 encounters, was arrested on Thursday night and would be shortly produced in court. The arrest comes in the wake of investigations made by a Special Investigation Team (SIT) appointed by the Bombay

High Court into the alleged encounter of gangster Ram Narayan alias Lakhan Bhaiya on November 11, 2006 near Nana-Nani park in suburban Versova, officials said.

Lakhan's brother, advocate Ram Prasad Gupta, had filed a petition in the high court alleging that the victim had been shot dead in cold blood by a police team headed by Sharma.

According to the petitioner, Lakhan was picked up from his house by police seven hours prior to his death. His family members had then filed a complaint with police fearing that he may be killed in an encounter. They had also sent telegrams to police commissioners of Mumbai, Navi Mumbai and Thane in this connection.

According to the police, Lakhan was close to Chhota Rajan henchman D K Rao.

Acting on a tip off that Lakhan would come in the park, they led a trap for him and in the subsequent encounter between the two sides, Lakhan was killed.

Following the petition, the court had ordered the probe by the SIT team headed by DCP M M Prasanna.

18 pct loan growth possible in FY10: SBI

Mumbai: Loan growth at State Bank of India, the country's largest lender, could reach 18 per cent in the current financial year to end-March, its chairman said on Friday.

"We will definitely cross 16 per cent as per our estimate. It is also possible to touch 18 per cent," O.P. Bhatt said at a news conference ahead of a banking conclave organised by the bank from Monday.

State Bank, which along with its associates controls almost a quarter of Indian bank loans and deposits, expects to maintain interest margins in the December quarter, Bhatt said.

He added that treasury gains are wearing off.

RIL revises Lyondell offer to $13.5 bn

New Delhi: Reliance Industries has offered USD 13.5 billion to buy LyondellBasell Industries, 12.5 per cent more than its previous offer, and may sweeten it further to get control of the bankrupt petrochemicals firm.

Mukesh Ambani-led RIL had in November offered about USD 12 billion in cash for a controlling stake in Lyondell and a couple of weeks ago sent a letter increasing its offer to USD 13.5 billion, sources familiar with the development said.

RIL has offered to buy about USD 2.2 billion in new stock and support a separate USD 2.8 billion rights offering by Lyondell to take the company out of bankruptcy. Most of the remaining would be in cash, they said.

The revised offer has not found much support from the US firm and RIL may sweeten the offer further, the sources said adding the company had time till February to make another offer.

An RIL spokesperson, however, declined to comment.

The Wall Street Journal, meanwhile, reported that Lyondell's board had rejected RIL's revised offer. It saw Lyondell valuation at about USD 15.5 billion, USD 2 billion more than RIL's revised offer.

Lyondell had a year ago filed for Chapter 11 bankruptcy protection under the US law after being unable to meet its debt obligations when global economic downturn saw demand dropping.

Economy may grow at 7% this year: PM

New Delhi: The Indian economy is expected to grow at 7 per cent this year and may soon return to sustained high growth path of 9-10 per cent, Prime Minister said on Friday at a conference of non-resident Indians.

Manmohan Singh said the government would like to address key constraints in the infrastructure and the agriculture sectors.

Cairns is welcome to sue me: Lalit Modi

Sydney: Indian Premier League boss Lalit Modi defended the IPL’s decision not to include Chris Cairns in the auction over alleged match fixing allegations, and said that the former New Zealand all rounder is free to sue him.

Hitting back at the Kiwi all rounder, Modi said: “Cairns is welcome to sue me if he wants.”

Modi rejected Cairns application to feature in the auction for IPL-3 because of his dismissal from the rival Indian Cricket League in 2008 over alleged match fixing charges.

Cairns said: “The allegation made by Lalit Modi that I have been involved in match fixing is scandalous and wholly untrue. For him to circulate such a falsehood around the world is outrageous. Modi’s allegation has caused me huge personal distress and professional damage.”

“I cannot allow these slurs to ruin my future and I have instructed my solicitors, Collyer Bristow LLP, to bring proceedings for defamation against Modi,” The Sydney Morning Herald quoted him, as saying.

Earlier Modi had said on Cairns: “Legally you may be correct. But he has a stigma around him for the same and as such the governing council has decided to withdraw his name from the auction.”

“Our tournament is by invitation only and as such we take issues at anything to do with match-fixing very seriously. Similarly Dinesh Mongia will not be allowed. We have zero tolerance for anything to do with the subject and as such will not like to take any chances if we don’t have to.”

Cairns and Mongia were sacked from the ICL for disciplinary reasons.

Dhoni, Kohli win it for India

Mirpur (Bangladesh): Mohammad Ashraful and Aftab Ahmed left the cricketing world shell-shocked when they led Bangladesh to victory against world champions Australia in 2005. In the last decade, the side has fashioned one-day wins against Pakistan, New Zealand, West Indies, South Africa and Sri Lanka. But ask anybody on the streets in Dhaka, and they will say that there is an extra edge that comes with humbling India — as their team had done one dramatic day at Port-of-Spain in 2007.

The Sher-e-Bangla National Stadium in Mirpur — which has been half-full and docile for the first couple of days — turned into an intimidating cauldron on Thursday night as India slipped to 51 for three within the ninth over of their chase. The visitors had lost Virender Sehwag, Gautam Gambhir and Yuvraj Singh already, and the Bangladesh faithfuls in the stands sensed another historic night.

But the noise which had reached a crescendo soon got mellow, as Mahendra Singh Dhoni played kill-joy in a cool and collected manner to lead India to a comfortable six-wicket win. Coming in to bat with 246 runs still required, the Indian skipper scored his seventh ODI ton — remaining unbeaten on 101 off 107 balls — and shared a 152-run stand with Virat Kohli, who scored a defiant 102-ball 91. Kohli fell nine runs short of a century, but Suresh Raina joined his captain and crushed the partisan crowd’s hopes of a dramatic turnaround, finishing with a 43-ball 51.

Earlier in the day, though, Shakib Al Hasan won the toss and bravely elected to bat — a decision which took even Dhoni by surprise, as he later pointed out — and his batsmen didn’t let him down. Led by Tamim Iqbal, Imrul Kayes and later Mahmudullah, the Bangladesh batsmen not only embarrassed India’s much vaunted bowling attack, they also piled on a number of batting records, as they reached 296 for six.

Srinagar gunbattle: JUM claims responsibilty, 100 evacuated

SRINAGAR: A policeman was on Wednesday killed and three civilians were injured as terrorists struck in the heart of Srinagar, entering a hotel lobbing grenades.

Jamiat-ul-Mujahideen, one of the rebel groups active in the area claimed responsibility for the attack by faxing a statement to the local offices of a news agency. ``The attack is in response to India's propaganda that the armed struggle has weakened in Kashmir,'' the statement said.

As it grew dark, the security forces put up floodlights around the Punjab Hotel building where the militants are holed up. The area has been marked off with concertina wires to ensure the guerrillas do not escape under the cover of darkness.

"We are cautious that no collateral damage takes place," a police officer said.

Police were not sure of any civilian trapped in the hotel building which hindered the prospect of launching the final assault. The militants were using the building as a fortified bunker and firing intermittently at the surrounding security forces.

"The hotel building will have to be stormed by commandoes if the militants refuse to surrender," said a paramilitary officer.

The dead policeman, identified as Mohammed Yusuf who was posted as driver of the Station House Officer of Maisuma Police station, was killed during the attack, official sources said.

Over 100 people, including women and children, who were trapped inside shops and other buildings near the scene of a gunbattle between militants and security forces at Lal Chowk here have been evacuated.

The injured civilians included a cameraman from a television news channel, said Sajad Ahmed, a police officer. The civilians were hospitalized with bullet and shrapnel wounds, he said.

Joint teams of police and CRPF personnel are engaged in the rescue operation and so far over 100 civilians trapped inside shops and other buildings have been evacuated from Court road, Pladium chowk, Koker Bazar and adjoining areas to safer places, a police officer said.

Three civilians, including Rauf, a cameraman of a Delhi-based private news channel, were also injured and have been rushed to a hospital, they said.

The terrorists are believed to be holed up in the hotel adjacent to historic Amira Kadal bridge in Lal Chowk area. The police had recently claimed that there had been a drop in militant violence.

Exchange of fire between the terrorists and the security personnel is continuing, the sources said. Grenade explosions and random gun-shots were heard, triggering panic among people.

The terrorists, believed to be "Fidayeen" (suicide squad), initially lobbed grenades on a CRPF picket at Pladium Chowk and followed it by indiscriminate firing around 2.15 pm.

The CRPF and police personnel deployed in the area retaliated and the militants, whose number could not be ascertained immediately, reportedly took shelter inside a hotel. They opened fire and lobbed grenades on the security forces.

The whole area was immediately cordoned off to neutralize the militants, a police officer said.

Immediately after the attack, people, including shopkeepers, present in the area fled to safety, while traffic went off the roads.

The entire area wore a deserted look with reinforcements rushing to the scene to tackle the situation arising out of the attack in the valley in more than two years.

The last suicide attack was carried out in Dal Lake area of Srinagar in October 2007 in which two terrorists were killed and three securitymen injured.

Today's attack came a day after the National Conference-led coalition government completed its first year in office and listed in its achievements, improved security situation.

It's no big deal, Amar Singh has resigned earlier as well: Mulayam

NEW DELHI: Samajwadi Party chief Mulayam Singh Yadav today sought to downplay the resignation of his close associate Amar Singh from key posts of the party, saying there were no differences with him.

"It's no big deal, he has resigned earlier as well," Mulayam Singh said. "He has resigned only from the post of general secretary and not from the party," he said reacting to Singh's announcement that he had quit all the party posts - general secretary, spokesperson and member of party's Parliamentary board.

Yadav denied that there were any differences between him and Amar Singh.

"There is no such thing. I spoke to him only a couple of days back," he said when asked whether any differences had resulted in the step taken by the 53-year old leader, who was considered his right hand man.

Asked whether he would persuade Amar Singh to take back his resignation, Yadav said, "We don't share such a relationship."

Singh's decision came amid speculation that he had differences with Yadav after Firozabad Lok Sabha by-poll debacle. Amar Singh had criticised Yadav and his family, saying they were over confident, which had led to the defeat.

When pointed out that Amar Singh had cited health as the reason behind quitting the key posts, the SP chief said, "It is true that he is not well."

No soft approach towards India: Pak Defence Committee of Cabinet

ISLAMABAD: Pakistan's political and military leadership on Wednesday decided not to adopt any soft posture towards India, saying that no one should underestimate Pakistan’s capacity to safeguard its sovereignty.

The decision was taken in a meeting of the Defence Committee of the Cabinet (DCC) in connection to the recent remarks of the Indian army chief Deepak Kapoor about pursuing a proactive strategy to simultaneously wage wars against China and Pakistan. The remarks of Indian army chief produced uproar in local media while the country’s military and political leadership responded by making bunt statements.

According to official sources, the meeting of DCC, the country’s highest forum for defence policy consultation and coordination, decided to bring Pakistan’s diplomatic and military policies in line with India’s aggressive stance towards the country. The committee said that Pakistan’s defence forces and its strategic and conventional capabilities would continue to be strengthened, the sources added.

The committee was also briefed on the latest security situation in the troubled North and South Waziristan tribal regions by the top military officials.

The briefing coincided with US drone strikes in North Waziristan, killing four militants and injuring two others, on Wednesday, local security officials said. “The missiles hit a militant compound in Datta Khel area of North Waziristan which was believed to be a training camp of militants. We have reports that four people have been killed,” an intelligence official said. It was the third drone strike this year in the lawless Waziristan region while 51 strikes were carried out in 2009, according to a Reuters tally.

The US has been pushing Pakistan to take action against other Taliban groups in North Waziristan, particularly the Haqqani network. North Waziristan on the Afghan border is a well-known sanctuary for al Qaeda and Taliban militants.
The DCC meeting decided, the insiders said, that Pakistan will not declare military offensive in North Waziristan under external pressure.

The participants of the meeting agreed that the final decision regarding a military operation in North Waziristan would be taken only after assessing ground realities.

Oz asks India not to fuel 'hysteria' over student's killing

Melbourne: Australia on Wednesday asked India not to whip up "hysteria" over a young expatriate's murder in Melbourne saying such incidents occur everywhere including in Mumbai, London and New York and claimed it remained "safe" for foreign students, amid India's warning to its citizens to be cautious in this country.

There was no evidence to suggest that the attack on 21-year-old Nitin Garg, a student who was fatally stabbed in the abdomen on Sunday, was racially-motivated, acting Foreign Minister Simon Crean said, adding it was one of a spate of stabbings in Melbourne over the Christmas period.

"It so happens that one of the victims is Indian ... Melbourne is not the only city in the world where this happens. It also happens in Delhi and in Mumbai," Crean was quoted as saying by 'The Age'.

About comments by External Affairs Minister S M Krishna who termed the killing of Garg as a "brutal attack", Crean said he hoped "wiser heads will prevail."

Krishna had also warned that such incidents could have a bearing on bilateral ties.

The report said Crean asked Indian leaders not to fuel hysteria over the issue, while conceding that there could be economic repercussions of the issue.

Deputy Prime Minister Julia Gillard, meanwhile, insisted that her country is safe for all international students and said "acts of violence" occur in big cities around the world.

Her comments came in the wake of India issuing a travel advisory for Australia.

Russian rape case: John Fernandes surrenders

Panaji: Goa politician John Fernandes, accused of raping a Russian girl on Colva Beach on December one, surrendered on Wednesday before the Crime Branch in Panaji almost a month after he went missing.

Deputy Superintendent of Police Chandrakant Salgaoncar told reporters that John has been placed under arrest and would be interrogated to get further evidence in the case regarding alleged rape of the 25-year-old girl.

The accused would be charged with destroying evidence as he had submitted his false clothes to the investigating agency earlier, the officer said.

John, a South Goa-based politician, who unsuccessfully fought 2007 assembly elections on Save Goa Front Party ticket, allegedly raped the girl by spiking her drinks at Colva beach. Salgaoncar said the accused was absconding from the time the Panaji bench of Bombay High Court rejected the anticipatory bail granted to him by District and Sessions court.

The accused also approached the Supreme Court with the anticipatory bail plea but the same was dismissed by the apex court.

Police stated that the accused walked into Crime Branch's office at Dona Paula with his lawyer at 1400 hours today. "He was immediately placed under arrested as we were looking out for him for his custodial interrogation," he said.

The Crime branch will also initiate inquiry into John's movement since he went missing. "If some people have helped him to hide, we will initiate action against them too for harbouring a criminal," the DSP said.

Police had issued look out circulars after John went missing and he was declared an absconder by Judicial Magistrate First Class (JMFC), Margao.

Sensex at 22-month high, see resistance

Mumbai: Equities stretched a rally into a fourth successive session on Wednesday, but there was resistance after the benchmark index hit a 22-month-high in early trade.

Investors took profits in export-focused outsourcers such as Infosys Technologies and Wipro that had more than doubled over the past year.

"The market is fairly priced at current levels. All eyes are now on earnings. Results are expected to be good, but that seems to be already there in the prices," said Gajendra Nagpal, CEO of Unicon Financial.

The 30-share BSE index closed up 0.08 per cent, or 14.89 points, at 17,701.13 after racing to 17,790.33 early, its highest level since Feb. 28, 2008.

Volume was relatively high for the third consecutive day, indicating longer trading hours kicked off on Monday were boosting business.

In the broader market, gainers led losers in the ratio of 1.1:1 on volume of 602 million shares.

Energy giant Reliance Industries, which has the highest weight on the Sensex, recovered 1.8 per cent to Rs 1,088.80 after dropping as much over the two previous sessions.

Financial stocks gained as investors were optimistic about their long-term prospects in a growing economy.

Top lender State Bank of India climbed 0.6 per cent while rival ICICI Bank gained 0.9 per cent.

Infosys shed 1.4 per cent and Wipro lost 1.7 per cent, after rallying 131 per cent and nearly 200 per cent respectively since the start of 2009.

Infosys, the No. 2 Indian outsourcer, is set to announce quarterly results on Jan. 12.

Google unveils Nexus One ‘superphone’

Mountain View: Google Inc took the wraps off the first of its smartphones on Tuesday, a device with speech recognition that it hopes can take on Apple's iPhone over time and help shore up the company's dominance in Internet advertising.

Analysts say the phone -- to be sold directly to consumers -- is not expected to dramatically alter the carrier-hardware vendor relationship the industry relies on, nor is it likely to yield a revenue windfall in the short term, though executives said it could be profitable.

Google plans to use what it calls a "superphone" -- the first of many types of smartphones that it will make -- to expand its reach from the PC to the mobile world and ensure its online products and ads get prominent placement on a new breed of wireless Internet devices.

The highly anticipated Nexus One, which marks the first time the 11-year-old Internet search titan has designed and sold its own consumer hardware device, could provide Google with a viable challenge to the iPhone and Research in Motion's BlackBerry.

It "wasn't the game-changer people thought it could be," Canaccord Adams analyst Jeff Rath said. Google could have shaken up the industry by offering the device for free, but instead chose more traditional pricing, he said.

Rath added that though his early impression was that the Nexus One was a good phone, it was unclear how much better it was than Motorola's Droid, released last year and that also runs on Google's Android operating system platform.

Mumbai to clash with Karnataka in Ranji Trophy final

Bangalore: Holders Mumbai earned yet another shot at the Ranji Trophy title as they entered the final of the domestic cricket championship on the basis of their first innings lead over Delhi in the semi-final tie, which ended in a draw in Mumbai on Wednesday.

The huge 289 runs first innings lead, that the 38-time champions took on Tuesday was enough to pilot Mumbai into the five-day final against Karnataka. Karnataka, six time winners, have also made the summit clash by the virtue of their first innings lead.

The final match will begin in Mysore from January 11. Mumbai have entered the final for the 43rd time.

The hosts were bundled out for 187 in their second essay with Delhi spin twins Vikas Mishra (6/49) and Aditya Jain (4/43) shared all the wickets between them.

Chasing 477 to win, Delhi then made 160 for four with left-handed opener Shikhar Dhawan (40) being the top scorer. Mumbai left-arm slow bowler Iqbal Abdulla grabbed three for 53, before play was called off by mutual consent.

Delhi's inability to grab the early advantage of having reduced the holders to 85 for three before lunch on day one was the turning point, according to Mumbai captain Wasim Jaffer.

The visitors allowed Mumbai to surge to a match-deciding first innings score, Abishek Nayar's gutsy 156 being the cornerstone.

Churchill players granted bail in airhostess molestation case

Three members of Goa's leading football club Churchill Brothers were granted bail on Wednesday after they were arrested in Mumbai for allegedly misbehaving with an airhostess and other cabin crew members on board a SpiceJet plane.

Nigerians Odafe Okolie (25) and Ogba Kalu (20), and goalkeeper Arindam Bhattacharya (20) were arrested last night from the Mumbai airport for allegedly pushing and teasing an airhostess of the SpiceJet flight they were travelling in.

All three were booked on charges of outraging the modesty of a woman, which is a bailable offence. They were granted bail on a personal bond of Rs 5000 each.

The team was on its way from Goa to Kolkata via Mumbai for their I-League match against Mohun Bagan on Friday. The trio were offloaded from the SpiceJet flight SG 804 after the incident was reported to the CISF.

England furious over ball tampering charges on Broad, Anderson

Cape Town:England coach Andy Flower has said that he has been taken aback by the ball-tampering row which overshadowed day three of the third Test against South Africa in Cape Town.

Flower’s comment came after the South African team raised their concerns over shots of fast bowler Stuart Broad treading on the ball with his spikes and James Anderson poking at it with his fingers at an early stage of the second innings.

“Over the years we have seen a lot of tall fast bowlers stop the ball with their boot, so I don’t see anything sinister in it at all,” The Telegraph quoted Flower, as saying.

The images can hardly be considered conclusive evidence of tampering, but the South African team alleged that the two bowlers were trying to alter the condition of the ball to aid reverse swing, one of England’s most potent weapons.

The incident was made official by South Africa at the close of play, which ended with the host nation at 312 for two, 330 runs ahead of England with two days to play.

“We have raised our concerns with the match referee over the condition of the ball and we have left it to him to decide whether action is necessary,” a South Africa spokesman said.

Meanwhile, England spokesman said: “We firmly rebut any accusations of ball tampering.”

Pakistan should fight all terrorists with 'same force': India

On Board Special Aircraft: India on Thursday asked Pakistan to "show the same force" in fighting anti-India terrorists on its soil as it has done in combating the Taliban and other anti-West militants.

"Pakistan has taken certain steps like fighting the Taliban in the Swat valley," external affairs minister SM Krishna told journalists when asked if Islamabad was showing commitment in fighting terrorists who target India.

"We expect Pakistan should go after the terrorists, who are targeting India, with the same force," he added.

He was interacting with journalists while returning from the Thai island resort of Phuket, where he participated in the ASEAN Regional Forum meeting.

Asked about Jamaat-ud-Daawa (JuD) chief Hafeez Saeed, suspected to be a mastermind of the Nov 26 Mumbai terrorist attacks, Krishna said Pakistani authorities had made an appeal in court against his recent release. "The law should take its course," he said.

"Pakistan should take action against any head of a terrorist organisation working against India," he added.


Kasab's 'confession' accepted on record, 26/11 trial to continue

MUMBAI: On a day of drama, Mohd. Ajmal Amir Kasab's lawyer decided to withdraw from the 26/11 terror attack case but later retracted even as the special court on Thursday ordered that the trial of the Pakistani gunman will continue.

Kasab's lawyer Abbas Kazmi told the court that he would like to pull out of the case as his client has lost confidence in him but later said he will continue to represent him.

Special Judge M L Tahilyani, hearing the case in the high security Arthur Road jail in central Mumbai, said the trial will continue as Kasab has confessed to the basic offence but not pleaded guilty to 86 charges slapped on him.

The judge told 22-year-old Kasab, "Aap ke khilaaf 86 charges frame kiye the. Apne sab nahin kabool kiye hain, lekin gunaah kabool kiya hai. Isiliye court ne decision liya hai ki yeh case chalega. (There were 86 charges framed against you. You have not pleaded guilty to all of them. You have confessed only to the basic offence. That is why the court has taken the decision to continue with the trial)."

To this, Kasab just said "theek hai "(okay). Taking everyone by surprise, Kasab had on Monday pleaded guilty to his involvement in the attacks at the Chhatrapati Shivaji Terminus and other locations. The terror strikes by Kasab and nine others in Mumbai had left 183 dead.

In his order, the judge said the court has come to a conclusion that Kasab's statement should be taken on record and considered at an appropriate stage as evidence.

The court instructed the prosecution to continue with the trial and produce witnesses.

"The prosecution's stance is totally vindicated by the order of the court," special public prosecutor Ujjwal Nikam told reporters outside the court.

"The court has accepted our contention that Kasab has not pleaded guilty for the entire incident and did not confess to all the charges. The court has said that his admission of guilt can be taken on record and will be considered at a later stage," Nikam said.

The prosecution had argued on Wednesday that Kasab's confession be taken on record but the trial should be allowed to continue since the gunman had not admitted to his guilt in all the offences in which he was involved.

However, the defence lawyer had argued that Kasab should be sentenced if his plea was accepted. Else, the court should reject it and not take the statement on record at all.

As the hearing commenced, Kazmi said, "Sir, I feel I should withdraw at this stage. He (Kasab) does not take me into confidence and I will recuse myself."

The judge then explained to Kasab in Hindi that his lawyer has gained an impression on his having no confidence in Kazmi and hence wants to withdraw.

"Maine aise kuch nahin kaha hai (I have not said anything like that)," Kasab said.

The court then told Kasab to speak with his lawyer and clear any misunderstandings between them. "It appears he has certain misunderstandings. Your duty is to clear it and I do not think it is a big issue," the court said.

India denies receiving ‘counter terror dossier’ from Pak

New Delhi: India denied having received any dossier from Pakistan about its alleged involvement in terrorist acts there, including one on the Sri Lankan team, a day after media reports in Islamabad claimed that a dossier was given to New Delhi on the issue.

"We have not received any such dossier," sources in the Prime Minister's Office (PMO) said in New Delhi.

The Dawn, a leading Pakistani English daily, had claimed on Wednesday that Islamabad has handed over to New Delhi a dossier containing "comprehensive evidence" of Indian involvement in several terrorist acts on its soil, including the attack on the Sri Lankan cricket team in Lahore in March.

The dossier with proof of "India's involvement in subversive activities in Pakistan" was handed over by Prime Minister Yousuf Raza Gilani to his Indian counterpart Manmohan Singh during their recent meeting at the Egyptian resort of Sharm el-Sheikh, the newspaper claimed quoting sources as saying.

Minister of State for External Affairs Shashi Tharoor described the charges of India's involvement in terrorist acts as "preposterous" and said "it is not wise for us to react to media reports.

"But we don't believe that deflecting responsibilities for things that are happening in the disfunctioning of the state to their neighbours who have conducted themselves very differently is a very healthy practice."

Denying that India has received any dossier from Pakistan, Minister of State for External Affairs Preneet Kaur said, "No such dossier was given in Egypt...It is entirely wrong."

Asked if the government sees these charges as a game, she said it was not good on Pakistan's part to do anything like this if they want to take the relationship with India forward.

Lucknow:Accusing the Mayawati government of foisting false cases on her, Uttar Pradesh Congress president Rita Bahuguna Joshi said on Thursday that she was treated like a terrorist in the jail.

"I was implicated in false cases and was treated like a terrorist in the jail. Torching of my house (in the state capital) was also state-sponsored," she told reporters in Lucknow.

Joshi said she was not settle anything less than a CBI probe into the arson incident at her house on July 15, adding without such an inquiry, "real culprits cannot be nailed".

The state Congress chief had moved a writ petition in the Allahabad High Court seeking a CBI inquiry into the attack on her house. It will come up for hearing tomorrow.

The Congress would launch statwide protests, including fill the jail stir, from August one if the demand for a CBI probe was not met by then, the UPCC chief said.

Nilekani takes over as head of UIAI

NEW DELHI: Infosys co-founder Nandan Nilekani on Thursday took over as head of the Unique Identification Authority of India (UIAI) which has been tasked to create a national database of identity details of citizens.

Nilekani said the first set of database will be ready in 12 to 18 months time as announced by Finance Minister Pranab Mukherjee in his budget speech.

"We will be issuing the first set of identification numbers in 12 to 18 months," he told reporters here.

Nilekani said Ram Sevak Sharma, a 1978 batch Jharkhand cadre IAS officer, will take over as Secretary and CEO of the organisation.

Nilekani, who was appointed as head of UIAI on July 13, said it will take few weeks for them to "get the team together"

"We will use biometrics....but we still have not decided what that set will be," he said.

"It will take us few weeks to stabilise and figure out the team size. It will take us few weeks to get our thoughts together," he added.

Talks on with MTN on deal: Bharti

New Delhi: Bharti Airtel Ltd said it is still in talks with South Africa's MTN over a deal which could see a merger of the two telecom giants with a combined revenue of 20 billion dollar.

The two companies would be in exclusive talks till July 31.

"Talks are going on between Bharti Enterprises, the parent of Bharti Airtel, and South Africa's MTN Group Ltd. to form a global business combination," Akhil Gupta, deputy group CEO and MD, Bharti Enterprises, said.

Gupta didn't elaborate any further.

Bharti Airtel and MTN had in May revived talks over a complex USD 23 billion combine that would create one of the 10 largest companies in the mobile telecom sector. Their merger talks last year had fallen apart as they could not reach an agreement on a management structure.

If successful, the combined wireless group will have more than 200 million subscribers and a combined revenue of USD 20 billion.

The Indian telecom major is exploring a potential transaction whereby it would acquire 49 per cent in MTN, and in turn, MTN and its shareholders would acquire approximately 36 per cent economic interest in Bharti.

The Securities and Exchange Board of India (SEBI) has exempted MTN from making an open offer to Bharti shareholders.

The market regulator, however, said the open offer would be triggerred only once the global depository reciepts (GDRs) are converted into local shares with voting rights.

Sensex closes above 15k, adds 388 pts

Mumbai: The Bombay Stock Exchange benchmark Sensex spurted nearly 388 points on Thursday on aggressive buying by funds, triggered by better-than-expected corporate earnings and firming Asian markets.

Market players covered pending positions amid reports of good quarterly earnings by blue-chip stocks and this further supported the rally.

The Sensex, which had lost 220 points in the previous day's trading, rebounded to end with a gain of 387.92 points at 15,231.04 as 28 stocks among the 30 in Sensex gained and two settled with losses.

The key index moved between 15,264.84 and 14,997.75.

The 50-share National Stock Exchange index Nifty rose 124.85 points to 4,523.75. It touched the day's high of 4,532.40 and a low of 4,405.95.

Brokers said the rally on other Asian equity markets with Hong Kong's Hang Seng index rising by 2.96 per cent and encouraging quarterly earnings by blue-chip companies mainly buoyed trading sentiment.

They said sentiment turned bullish on steady news of good quarterly earnings by pivotals led by ITC Ltd, and positive economic data boosted trading sentiment.

Major gainers that supported the Sensex were Reliance Industries, Infosys Technologies, ICICI Bank, ITC Ltd and Maruti Suzuki. All the five carry nearly 34 per cent weight on the index.

Colombo: Sri Lanka face an uphill battle to save the third Test against Pakistan after closing on 183 for three chasing a huge 492-run victory target on Thursday.

The hosts started their chase positively with an opening stand of 83 either side of tea, but lost the wickets of Malinda Warnapura (31), Tharanga Paranavitana (73) and Mahela Jayawardene (two) in the final session.

Captain Kumar Sangakkara, dropped on 40 by Younus Khan, was unbeaten on 50 at the close with Thilan Samaraweera on 20.

The biggest challenge for the hosts will be the leg spin of Danish Kaneria, who followed his first innings five-wicket haul with two for 56 from 16 overs.

Kaneria found sharp turn and bounce on the dusty-dry pitch, snaring the left-handed Warnapura at leg slip and finding the outside edge of Jayawardene's bat with a big leg break.

Johannesburg: As South Africa gears up to host next year's football World Cup, it is taking steps to make sure the fans go home when it's over. South Africa, the strongest economy on the continent, has an estimated 3 million to 5 million undocumented African immigrants in a population of 47 million, according to the South African Institute of Race Relations, and their presence has already sparked bloodshed.

Now some are predicting eased entry procedures for the monthlong tournament will make things worse. George Khola, 36, a Ghanaian who sells fruit and vegetables at a Johannesburg market, is sure that the migrants numbers will soar with the approach of the games. "This is the chance," he said. "The whole of West Africa will come."

Others say that with or without the World Cup, the migrants will keep coming in search of jobs, or as refugees from persecution and poverty. "We know that South Africa is a magnet for migration on the continent," said Morne Fourie of the government agency that regulates immigration. Dr. Darshan Vigneswaran, a migration expert at Johannesburg's University of Witwatersrand, says they'll keep coming because entry is easy enough by paying a bribe at the border.

The government says it is working on ways to balance welcoming the fans and making this an event for the whole continent, without compromising borders. "This is Africa's World Cup, not just South Africa's," Fourie said.

South Africa is spending nearly $145 million to streamline entry for the games. It is the first World Cup host to offer an "event visa" for visitors from countries lacking visa-free arrangements with the host government. They will have to show a purchased match ticket, an address while in South Africa and a return ticket home. Immigration officials will run spot checks on the addresses and deport overstayers. But finding them could be difficult. Once inside South Africa, it should be easy to melt in among the illegal immigrants already here.

Hodge left out as Australia name 30-member CT squad

Melbourne: With a view to build a team for the 2011 World Cup, Australian selectors included three new faces while leaving out batsman Brad Hodge in the preliminary squad of 30 for the ICC Champions Trophy to be held in September in South Africa.

Tasmania wicketkeeper Tim Paine, Victoria spinner Jon Holland and New South Wales all-rounder Moises Henriques figured in the probables' list for the September 22 to October 5 tournament. The squad must be trimmed to 15 players by August 23.

The squad does not include controversial all-rounder Andrew Symonds, who was sent back home from England on disciplinary grounds just before the start of Twenty20 World Cup besides scrapping his Cricket Australia contract.

Test cricket not dying: Ganguly

London: Refusing to paint a gloomy picture of Test cricket, former India captain Sourav Ganguly on Thursday said the five-day game poses no serious threat from other formats and for a player it will always be the ultimate form of cricket.

With the ever-growing popularity of T20 cricket, there is growing fear that the traditional format of the game is in danger of dying a silent death, but Ganguly would beg to differ. "Test cricket will survive and other cricket will also survive because Test cricket has to survive," Ganguly told reporters today at Oxford, where he is attending the ICC's History Conference. "Test cricket is the ultimate form of cricket and I know for sure players will be remembered with what they do in Test matches," he added.

Ganguly praised current Indian team under Mahendra Singh Dhoni and said the side has what it takes to be at the top of world cricket. "India is a fantastic team at present. If they keep performing as they have in the last two or probably three, four, five years, in future they will definitely be the number one in the world," said India's most successful skipper. Ganguly had some special word of praise for Gautam Gambhir, who recently rose to the number one spot in ICC Test batsmen rankings. "Gambhir and Dhoni are fantastic players. I am particularly very happy to see Gambhir getting there, being the number one Test batsmen because that's what complete batting is all about," Ganguly said. "I have seen him young, he is a left-hander and it is great to see him do good for India," he added.

MELBOURNE: Two fresh cases of assault on Indians have been reported in Australia, with three students being injured in two separate incidents in Sydney and Adelaide despite serious efforts by the country to re-establish its image as a safe destination for international students.

Two students were injured outside a hotel in Sydney last week in what appeared to be a petty street crime, apart from a separate incident surfacing from Adelaide.

New South Wales Police official Brian Wyver said the two men in Sydney suffered minor injuries in a scuffle outside a hotel in Wollongong on Friday.

"When the police arrived they couldn't locate anyone there... They later found that two people had been taken to Wollongong Hospital by a friend," Wyver was quoted as saying by the 'Herald Sun'.

"They attended the hospital and there appears there has been some sort of fight outside the hotel. They didn't want any action in relation to that fight, they weren't badly injured so police have taken a report," he said.

Wyver said the students did not indicate that the fight had been racially-motivated, and they did not want to press charges. "We have asked for CCTV footage from outside the hotel to find out what happened," he added.

In another case, an Indian student was attacked in Adelaide after a group of four drunken localities attacked him.

Gurgaon: Noting that Pakistan houses a ‘syndicate of terrorism’, US Secretary of State Hillary Clinton said her country is watching the actions being taken by Islamabad against the scourge and expected that perpetrators of Mumbai attacks meet their ‘day of reckoning’.

She emphasised that terrorism is a threat to all, including those who have given haven to such elements, and every country should stand up to defeat the menace.

"We are certainly watching and expecting that there will be justice and those who launched the horrific attacks in Mumbai will meet their day of reckoning," she said at an interaction with press.

Clinton, who will meet Prime Minister Manmohan Singh and hold talks with External Affairs Minister S M Krishna on Monday, said she realises that the ‘syndicate’ of terrorism in Pakistan is ‘troubling’ India, besides the US.

"I have also sent messages very directly to the Pakistani people that this (fight against terrorism) is in the interest of Pakistan, the future stability and security of Pakistan," said the Secretary of State, who is on a five-day visit to India.

She said the US had "seen an evolving commitment, not only by Pakistani Government but also Pakistani people and a recognition that terrorism within a country is a threat to that country".

'LeT operatives provided transport, funds to 26/11 attackers'

Islamabad: Five LeT operatives arrested in connection with the Mumbai terror strikes, including its operations chief Zakiur Rehman Lakhvi, provided transport, accommodation and financial support to the 26/11 attackers, according to an updated supplementary chargesheet filed before a Pakistani anti-terror court.

The second chargesheet against the five men -- Lakhvi, Lashkar-e-Toiba's communications expert Zarar Shah, Hamad Amin Sadiq, Shahid Jamil Riaz and Abu al-Qama -- was filed by the Special Investigation Group of Federal Investigation Agency (FIA), which probed the Mumbai attacks, in a Rawalpindi anti-terror court yesterday.

The chargesheet states the five suspects provided transport, boats, financial aid, accommodation and a computer network to attackers who killed more than 180 people in Mumbai, media reports said.

The FIA also submitted the confessional statement made by Ajmal Amir Kasab, the lone terrorist arrested for the attacks, to an Indian magistrate.

Dermatologist claims he fathered Jacko's two kids

London: In a new development to the custody battle of Michael Jackson's three children, his dermatologist has claimed that he is the biological father of the pop star's two elder children.

Dr Arnold Klein, Jackson's dermatologist for last 25 years, is reportedly planning to apply for the guardianship of Prince Michael, 12 and Paris, 11 and consulting his lawyers about his options.

"Arnie is planning to fight for custody of Prince Michael and Paris. He says he can prove he is their father with Debbie," a close friend of the doctor told Sunday Mirror.

Klein was Debbie Rowe's boss when she married Jackson in 1996 and he has never outrightly rejected claims about being the secret sperm donor for Prince and Paris, who many point out have a close physical resemblance to the doctor.

Jackson's mother Katherine, 79, was awarded temporary custody of Prince Michael, Paris and the singer's youngest child, son Blanket, after his death.

She is applying for the permanent custody of the three children, but her lawyers are now in talks with Rowe, who wants some access to Prince Michael and Paris. A custody hearing has been postponed till August 3.

Jackson left his estimated USD 500 million fortune to his three children and his 2002 will, which names Katherine and soul diva Diana Ross as children's guardian, provides for a substantial amount to the caretaker.

Klein's claim is likely to add more confusion to the custody battle.

The doctor, openly gay, lives alone in a 3-million-pound, 30-room Los Angeles mansion after splitting recently from his lover, the newspaper said.

Though he has alway given cryptic answers about the paternity of Jackson's three children, he has told close friends that he fathered the children through artificial insemination with Rowe after a secret deal with Jackson.

The source said Jackson singled out Klein as a sperm-donor because of his intelligence and high IQ.

"Arnie has told his close friends he is Prince Michael and Paris's father for years, while never giving a straight answer in public.

"He says he was paid nothing for the sperm but was paid for keeping the information confidential. The kids have grown up with 'Uncle Arnie' visiting the house and spending holidays with them. He has always said he loves Michael's children, and remarked on how they are the most amazing kids he has ever met," the source added.

Jackson's mother, brothers and sisters reportedly dislike Klein as they believe that he manipulated the pop star with his smooth-talking ways and prescribed strong painkillers, which reportedly played a role in his death.

IT industry bucks recession to sustain growth

New Delhi: The Indian IT industry managed to limit the impact of global recession last fiscal and maintain the growth momentum, albeit lower than that in the boom times, says tech publisher Dataquest.

"Export firms did better in recession-hit developed markets than those whose business is limited to the Indian market," Dataquest editor Prasanto K Roy said.

Though the business of top 20 firms led by Indian IT bellwethers TCS, Infosys and Wipro, and multinationals such as HP and IBM, grew by an average 19 percent, seven of these posted single-digit revenue growth.

"Overall, the top 20 Indian software and hardware firms reported a combined revenue of Rs.183,621 crore (Rs.1.84 trillion/$39.52 billion) in 2009, compared to Rs.149,250 crore (Rs.1.49 trillion/$32.12 billion) in 2008," Roy said, citing findings of a survey.

Among the seven, four are multinational subsidiaries - Microsoft India, which grew a mere one percent year-on-year to Rs.32.98 billion (Rs.3,298 crore); HP India up two percent to Rs.157.63 billion (Rs.15,763 crore), Oracle three percent to Rs.59.62 billion (Rs.5,962 crore) and Cisco by four percent to Rs.60.84 billion (Rs.6,084 crore).

"One of the reasons for export-driven firms maintaining the growth is because of increasing IT outsourcing in a downturn to keep costs flexible. In the domestic market too, global firms such as IBM and Wipro fared very well," Roy averred.

Among the top 20 firms, eight firms grew fastest despite slowdown and negative sentiment in the market.

These include Mphasis, with revenues increasing 69 percent to Rs.31.73 billion (Rs.3,173 crore); HCL Infosystems, up 60 percent to Rs.80.89 billion (Rs.8,089 crore) and Cognizant Technologies, up 49 percent to Rs.94.10 billion (Rs.9,410 crore).

The IT bellwethers also posted healthy growth rates. TCS was up 22 percent to Rs.25,895 crore; Infosys, up 31 percent to Rs.20,392 crore, and Wipro up 41 percent to Rs.23,882 crore.

Multinationals such as SAP India grew 33 percent to Rs.4,320 crore, Dell India by 32 percent to Rs.4,266 crore, IBM India by 19 percent to Rs.12,048 crore and Accenture by 16 percent to Rs.4,400 crore.

With a decline of 18 percent in its growth, hardware firm Lenovo failed to make it to the top 20 club. Korean major Samsung also saw growth falling 40 percent to Rs,1,200 crore from Rs.2,014 crore.

Export revenues do not include that of business process outsourcing (BPO) services.

Scam-tainted Satyam Computer Services has been left out of the top 20, as its financial performance came under cloud following the Rs.78-billion (Rs.7,800-crore) accounting fraud by founder-chairman B. Ramalinga Raju.

The Dataquest survey findings are lower than the projections made by the IT industry's representative body -- National Association of Software and Services Companies (Nasscom) -- for 2009-10.

With the industry's annual growth rate dipping to 16-17 percent from about 30 percent in 2004-2008, the aggregate revenues was estimated to be $60 billion, including export revenue of $47 billion.

In view of the prevailing uncertainty, Nasscom has taken a two-year view to factor in the volatile environment and estimated that the IT industry would grow at 15 percent to achieve export revenue of $60-62 billion by 2010-11.

Rs 600 crore Satyam shocker for Anand Mahindra?

Sunday July 19, 2009: Industrialist Anand Mahindra is in for a major shock. Maytas Infra and Maytas Properties — companies run by the two sons of the jailed Ramalinga Raju — are soon likely to present him a bill of about Rs 600 crore. Reason: this is the sum that Satyam, the new Mahindra acquisition, owes the two Maytas companies. And since both the Maytas companies are now down in the dumps, there is no way that serving of the "bill' can be delayed any further. Ved Jain, a former president of the Institute of Chartered Accountants of India (ICAI) and now a government-appointed director on the boards of both the Maytas companies, is on record stating that the two companies have documents to demonstrate that money from their coffers reached the treasury of Satyam in the days that Ramalinga Raju ran the company. Rs 380 crore went from Maytas Infra and Rs 220 crore from Maytas Properties. Of course it was not a straight deal — the money was transferred in a two-shot operation. In the first shot, the money reached some privately owned companies spawned by the Rajus by way of intercorporate deposits. In the second transaction the money went from these companies to Satyam.

Undoubtedly, Anand Mahindra and his chosen man for Satyam, Vineet Nayyar, are going to dispute these transactions. They are not going to fork out anything more than they offered at the auction of Satyam and subsequently paid to acquire Satyam. After all they don't have a money plant at their corporate headquarters.

In fact, before Ved Jain went public with the claims, the new bosses at Satyam had said that they had found no evidence of any cash received by Satyam from Maytas. This was neither detected by the government-appointed directors on the Satyam board who ran the company for three months before it was handed over to the Mahindras. However, readers may recall that a day after Raju made his historic confession on January 7, Satyam received a letter from Raju's brother, Suryanarayana Raju. Suryanarayana, who runs hundreds of privately owned companies belonging to the Raju family, said that Satyam owed more than Rs 1200 crore to these companies and these dues should be paid back. At that time nobody took the claims seriously viewing it as a last-ditch attempt by the Rajus to make more money out Satyam — the cash cow that had just got out of their hand.

But with Ved Jain's assertions, the whole matter assumes a new dimension. Now it is a claim that cannot be dismissed out of hand. It is clear that a legal battle will ensue with Satyam and Maytas arraigned against each other. Expect a lot of dirty linen to be washed in public.

With this latest revelation, the whole Satyam scandal now looks far more wider than what it had seemed to be the day Raju confessed to inflating revenues and profits of Satyam. Raju's lawyers have been after that asserting that there was nothing more to the scandal than that. Raju was just inflating the financials of Satyam so that it could look impressive. The lawyers also denied that Raju ever siphoned funds out of Satyam, although now the CBI is investigating this. This is not an easy task, considering that the siphoning took place abroad (by not bringing back the entire proceeds of exports or public issue to India and diverting it elsewhere). Even as the CBI investigates the matter, it is now clear that money was siphoned out of Maytas too. This is a new dimension to the case. And if you want to know how Maytas had all the cash to spare, you might recall that in late 2007 Maytas Infra did a hugely successful public issue that was subscribed many times over.

My feeling is that we have not heard the last of the Satyam scam. There could be many other dimensions to the scam that may become public in the future. Ramalinga Raju had a brilliant mind, and he was capable of conceiving and implementing extremely complex operations. The investigative skills of the police are no match to his dexterity. Even now sitting in jail Raju must be plotting his exit route. After long, last fortnight, the courts have given permission to the cops to administer a lie detector test on Raju and his brother Ramu and also do their "brain mapping". The efficacy of these tests is doubtful but let's wait and see what comes of it. My hunch is that nothing substantial will emerge.

London:England sensed history in the making on Saturday when they took an overall lead of 521 over Australia with two days' play left in the second Ashes test at Lord's. Vaas to quit Test cricket after Pak series

Colombo:Within a fortnight of dismissing his retirement 'rumours', Sri Lanka's most successful pacer Chaminda Vaas announced that he will quit Test cricket after the ongoing series against Pakistan.

"I'm officially retiring from Test cricket after the third Test against Pakistan but will continue playing one-day and Twenty20 matches till the 2011 World Cup," Vaas told reporters at the Sinhalese sports club.

Earlier this month, chief selector Asantha de Mel had revealed that Vaas had a discussion with him after the pacer had made up his mind to quit the longer version.

Vaas, however, went on to deny it and after being ignored for the first two Tests against Pakistan, the 35-year-old pacer was recalled in the Sri Lanka squad for the third and final match starting.

Sri Lanka captain Kumar Sangakkara, who had earlier announced that Vaas would get a farewell game, paid rich tribute to the pacer, who is the only third Sri Lankan after Sanath Jayasuriya and Muttiah Muralitharan to play more than 100 Tests.

Blasts at Jakarta Ritz, Marriott kill 9, wound 50

Jakarta:Explosions ripped through two luxury hotels in Jakarta Friday, killing nine and wounding at least 50 more, ending a four-year lull in terror attacks in the world's most populous Muslim nation. At least 18 foreigners were among the dead and wounded.

The blasts at the J W Marriott and Ritz-Carlton hotels, located side-by-side in an upscale business district in the capital, blew out windows and scattered debris and glass across the street, kicking up a thick plume of smoke. Facades of both hotels were reduced to twisted metal.

Police said they were investigating whether the blasts, detonated inside cafes in each hotel, were caused by suicide bombers, planted explosives or a combination of both. Several of the bombing suspects were believed to have been staying at the Marriott.

President Susilo Bambang Yudhoyono said the attack was carried out by a "terrorist group" and vowed to arrest the perpetrators. He said it was too early to say if the Southeast Asian Islamic militant group Jemaah Islamiyah, blamed for past attacks in Indonesia, including a 2003 bombing at the Marriott, was responsible.

"Those who carried out this attack and those who planned it will be arrested and tried according to the law," a somber-looking Yudhoyono told a news conference.

U.S. Secretary of State Hillary Rodham Clinton condemned the bombings as reflecting "the viciousness of violent extremists" and said they "remind us that the threat of terrorism remains very real." Maya's statue 'fetish' ignores UP's development: Rahul

METHI: Congress leader Rahul Gandhi on Friday described as "unfortunate" the comments by Uttar Pradesh unit chief Rita Bahuguna Joshi against Chief Minister Mayawati but criticised her fetish for installing statues while ignoring development.

Though he disapproved Joshi's comments, he said her anger and sentiments against the state government were "genuine".

He pointed out that the Congress party and its chief Sonia Gandhi have already disapproved of Joshi's remarks. He, however, parried questions whether action would be taken against Joshi saying it was the business of party President and other senior leaders to decide.

Stepping-up the offensive against the BSP government, Gandhi, on his thanksgiving visit after winning the Lok Sabha election, said he understood Joshi's anger when she criticised the government because nothing was being done for the people.

"I can understand her anger in dealing with the government because for all practical purposes it is not operational. We are in UP and it is our job to ensure that our programmes from Delhi are delivered to the people.

"We send huge amounts for schemes like NREGA and for providing electricity but they are wasted," Gandhi told reporters.

"Every leader has his priorities. The chief minister has the priority to do what she is doing by erecting statues, but I don't appreciate that the money we send gets wasted," Gandhi said.

The Congress leader said it was "hard to deal with the state government
as nothing is being done in UP".

"If installing statues is their priority its good for them. Our priority is that the programmers reach the poor people," he said.

He said that sentiment that the existing government was not working for poor and backward is correct and justified.

"I think that words used by Joshi were unfortunate. Even Congress president and the party had made it clear that they don't appreciate. But the sentiments and anger Joshi feels against the state government are genuine," Gandhi said.

"Wherever I go there is a common complaint that this government is doing nothing. In such circumstances there is a feeling of anguish that we are sending funds and it is not reaching the people," he said.

He criticised the police action against residents protesting against power crisis in Amethi.

"You have seen what has happened here. Police thrashed people who were protesting against power crisis. This is not what a normal and rational government does," he said.

On Samajwadi Party demanding that Congress clarify its stand on whether it stood with the party or BSP in Uttar Pradesh, Gandhi said, "We are neither with the SP nor BSP, we are with the poor people."

Asked whether he was trying to woo dalits, Gandhi said that the issue was not of "dalit agenda".

"It is not about dalit agenda, our agenda is that of poor people," he said.

He said that Congress' agenda is to work for the people of Uttar Pradesh. "And it will be clearly visible in time to come. People will realise that there is only one party which is working for the cause of poor and backwards and that party is Congress," he said adding the party "will give them hope".

Asked whether he suspected the involvement of police in arson at Joshi's house, Rahul said that his party will not get deterred by such incidents.

"Whether there is any government hand or the police is involved we are not bothered. Our work is simple, we are here to struggle for the poor people of the state and such an action will not make any impact on us," he said.

Joshi's remarks not pardonable, she will be punished: Maya

Lucknow:Congress President Sonia Gandhi's disapproval of Rita Bahuguna Joshi's remarks notwithstanding, UP Chief Minister Mayawati on Friday said legal action against her would continue and she would be punished.

She said Gandhi's disapproval of the UPCC chief's remarks was more of a "compulsion in the wake of the declining political graph of the Congress among the people, especially Dalits".

Mayawati told a press conference that the "reprehensive" and "derogatory" remarks made by Joshi were "not at all pardonable".

"Whatever legal action is being taken against Joshi on her July 15 remarks against me will continue and like Varun Gandhi, she may get bail, but it will not minimise the intensity of her crime," she said.

"Sooner or later she will be punished for the crime she has committed as per law," she added.

Mayawati, however, said that in view of Gandhi's disapproval of the remarks against her, her party will not disrupt business in both houses of Parliament.

The BSP chief said, "After my statement that Joshi made derogatory remarks against me in Moradabad on the directives of the Congress high command, Sonia Gandhi was compelled to express anguish and pain because of the declining goodwill of the party.

Police concluded their investigations into the case after the autopsy report released by the San Mateo county coroner's office revealed that Motwani's blood alcohol level was 0.26 when he died as against the US permissible driving level of 0.08.

San Mateo County Coroner Robert Foucrault termed it as an "unfortunate accident".

"It is difficult to know what effect a given alcohol level will have on a person because tolerance varies from individual to individual," Foucrault said.

"It was a contributing factor but the cause of death was drowning," he said, adding there would be no further investigation of the death.

The news of sudden death of 47-year-old Motwani, whose body was found in the swimming pool of his Palo Alto home June 5 had sent shock waves across the Silicon Valley.

Motwani's friends said, he was learning to swim.

Motwani was the brain behind several of the key advancements in the world of the internet, including Google and PayPal.

CAG flays Delhi Metro's quality control

NEW DELHI: Five days after a mishap at the Delhi Metro site claimed six lives, India's official auditor on Friday said it had found some glaring flaws in the quality control systems adopted by the state-run company.

Officials at the Comptroller and Auditor General of India's (CAG) office said there was also a departure from established norms in the bidding process to choose the contractors for the project.

The performance audit report on the Delhi Mass Rapid Transport System pertains to 2006-07 - the first phase of the Delhi Metro project - and was presented to the government last year but was not tabled in parliament.

"They (the government) deliberately delayed the tabling of the report on one pretext or the other. There were three sessions of parliament after we submitted the report," said A N Chatterjee, deputy comptroller and auditor general, at a news conference here.

"To hasten the project, quality control procedures were relaxed deliberately," he said, adding: "If these reports were presented in time, it would have been better as some of it has clear and direct linkage with what we are witnessing today."

Six workers were killed and 15 others injured when an elevated section of the Delhi Metro track under construction at Zamrudpur in south Delhi collapsed early Sunday morning. The next day, six people were injured at the same spot when three cranes, being used to remove a steel girder that had got inclined, suddenly toppled over.

According to the audit report, the Delhi Metro needed to evolve a mechanism for testing all materials through accredited laboratories. It said accountability issues should not be placed at unreasonable risk in the interests of expediency.

"Audit analysis of quality control indicated scaling down of testing requirements, non-witnessing of tests by the company's representatives, testing of material in non-accredited laboratories and non-preservation of test reports," the report said.

"The company has not prepared a corporate plan to chart out its goals and strategies for achievement of business development, diversification, technology upgradation, and customer satisfaction."

Good times are back: Job offers flood IIMs

BANGALORE: The green shoots are springing up and they're becoming visible at the Indian Institutes of Management, bringing some hope that the economy
is looking up.

Pre-placement offers (job offers which come to students before the final placements) have begun to pour in for the graduating class of 2010. The IIMs are seeing a positive response from all sectors.

At IIM-Bangalore, consulting firms, which participated in the summer placement last year have announced their PPO results and all students received PPOs. "IIM-Bangalore is the only IIM with a 100% success rate till now. While this speak highly about the institution as a brand, credit must be given to students and their calibre too. The success rate is actually better than last year's," Vineet Sharma, placement representative, IIM-B, told TOI.

Last year, 12 consulting firms participated in these process. Some of the firms were McKinsey & Co, Boston Consulting Group, Bain & Co. Also, consulting majors Alvarez & Marsal and Result recruited students for the first time.

This year, the positions offered vary a fair bit. "But, it's on a par with an entry-level MBA position across the world," Sharma said. Last year, 120 companies confirmed their participation for the 270 students.

During last year's summer placements at IIMB, overall 24% of the batch accepted a position in a consulting career, known for its demand for multi-functional skills and cutting across finance, strategy and marketing. Other sectors which saw a significant number of offers included finance (21%), investment banking (20%), marketing (13%) and general management (13%). Consulting firms like McKinsey & Co., Boston Consulting Group and Bain & Co. recruited the highest number of interns from IIM-B. Interestingly, students have also bagged 2-3 international offers.

IIM-Calcutta students too are happy as they've got offers from across sectors, including FMCGs. Though IIM-C refused to give the number of offers made, it said the offers are a positive sign for students, especially during this recession. Students here bagged offers from the finance sectors and international ones.

The IIM-C didn't rule out the possibility of more than 10 overseas offers. Paul Savio, external relations secretary, IIM-C told TOI that some banks have put off the PPOs till September. "Earlier, we'd get the offers during May-June from some firms. One reason could be that banks want to see if the markets are doing better and hire people, if required. However, we're only some of the few lucky IIMs to get offers from the finance sector," he added.

Indian Institute of Management-Indore (IIM-I) started to receive PPOs from mid-June. With 240 students in the 2008-10 class, PPOs are more from for the marketing and finance sectors. "We're constantly in touch with firms and received a positive response," sources at placement committee, IIM-I said. He said PPOs would pick up later this year. "However, it's better compared to last year's," he added.

Tata to deliver first Nano today

MUMBAI: The common man's car is set to reach the common man. After overcoming obstacles like rising commodity prices and political opposition,Ratan Tata will finally hand over the keys of the Nano — his dream project — to its first owner here on Friday.

The rollout, which begins on Friday, will prove to be the litmus test for the much-awaited car's on-road performance.

Tata Motors, through a lottery, selected one lakh customers out of the 2.06 lakh applicants who had booked the snub nosed car. While a significant number of people opted for a loan, the top-end LX model has been the most sought after. The first Nanos are being built at a plant in Pantnagar, northern India, which can produce 60,000 units a year.

Beginning Friday, the first one lakh cars would be delivered in a phased manner by the last quarter of 2010. The first one lakh owners are price-protected and will get the Nano at the ex-showroom price of Rs 1 lakh.

Lufthansa makes new offer on Austrian

Brussels: Lufthansa has made new concessions in its bid for Austrian Airlines to allay antitrust concerns, European Union regulators say.

EU spokesman Jonathan Todd said last week that chances of Lufthansa winning regulatory approval for the deal by July 31 were fading fast because the company was not doing enough to eliminate competition concerns that the deal would reduce choice and hike fares on some routes.

Lufthansa has the right to pull out of the takeover if EU approval doesn't come through by the end of July. Todd said that deadline was set by Lufthansa and the EU has until Nov. 6 to decide on approving or blocking the bid.

The European Commission said Friday it was seeking clarification from Lufthansa on its new offer. It refused to give details on what Lufthansa was now promising to do.

The EU executive says the new company could become too powerful on flights from Vienna to Frankfurt, Munich, Stuttgart, Cologne, Zurich, Geneva and Brussels. Lufthansa is Germany's biggest airline and Austrian Airlines dominates routes out of Austria.

Lufthansa last month resolved similar EU fears that its bid for Brussels Airlines would make it the only airline running some routes out of the Belgian capital. Regulators approved the deal after Lufthansa agreed to sell off airport slots to rivals - a move that would help rivals launch competing services.

Slots are the daily periods of time that airlines get to land and take off from airports. They are valuable, changing hands for as much as 30 million pounds ($48 million) a pair at Europe's busiest airport, London Heathrow.

Lord's Test: Australia in trouble at lunch

London:James Anderson made his highest score against Australia on Friday and then claimed two wickets to reduce the tourists to 22 for two at lunch on day two of the second test.

England lost captain Andrew Strauss for 161 on the second ball of the day at Lord's, but Anderson hit 29 to put on 47 in 53 balls with Graham Onions for the last wicket to help the hosts total 425 after overcoming the loss of three quick wickets.

Anderson built on the momentum by having Phillip Hughes caught down the leg side off his glove for 4 and then removed captain Ricky Ponting for 2, albeit controversially.

Ponting was given out caught at first slip by Strauss after a debate between the umpires with input from the third umpire to check the ball had carried. Man U scrap trip to bomb-hit Jakarta

Kuala Lumpur: English Premier League club Manchester United have cancelled their proposed trip to Indonesia following Friday morning's bomb blasts at two five-star hotels in national capital Jakarta.

Club coach-cum-manager Sir Alex Ferguson described the cancellation as a major disappointment for him and his team, and said the bomb blasts was "terrible news".

The Red Devils were to play a game against an Indonesian XI on Monday, reports The Independent.

One of the attacks was on the Ritz-Carlton, where United had been due to stay for four nights from tomorrow.

Speaking at a press conference this morning, Ferguson said: "We got the news as we landed and it is very disappointing. I have never been to Indonesia before and I know the Indonesian FA have worked very hard on this. It is terrible news, but we have taken what I believe to be the right decision in terms of safeguarding our players."

United's chief executive David Gill said they had met with officials from the British High Commission before deciding to cancel their trip.

The hotels are in an upmarket business district in Jakarta. The explosions blew out windows and scattered debris and glass across the street.

Although there have been no terrorist problems in the country for a number of years and presidential elections passed off peacefully recently, the Marriott Hotel was badly damaged by a car bomb attack in 2003 that killed 12 people.

That coincided with a period when Islamist militants from the Jemaah Islamiyah organisation were blamed for numerous attacks, including bombings on the island of Bali in 2002 that killed 202 people. Many militants have since been arrested.
